Inter-American Court rules access to fertility treatment is a human right



The Inter American Court of Human Rights has today announced its decision in an in vitro fertilization (IVF) case relating to the general prohibition of IVF in Costa Rica, the result of a decision by its Supreme Court in 2000. The ruling strongly supports the use of IVF by infertile couples who wish to use IVF.

The International Federation of Fertility Societies, which is the international body which represents scientists and clinicians working in assisted conception, welcomed the decision of the court.

IFFS President, Professor Joe Leigh Simpson (New York) said:

“We welcome the decision of the human rights court. At a national level, this means that Costa Ricans should now have access to fertility treatment. More than that, this is a landmark decision, which will have an impact throughout the Americas, and perhaps even throughout the world.  It means that denying access to fertility treatment is denying a human right. Infertility is a disease, and this decision means that people have a right to be able to be treated for this disease, including having access to IVF.”

IFFS Board member, Dr David Adamson (Palo Alto, California) said:

“The Costa Rica Human Reproduction Society (Asociación Costarricense de Reproducción Humana) is a member of the IFFS, so we are obviously pleased at the decision.  This decision of the Human Rights Court brings Costa Rica, and most of the Americas, into line with the views of the main international medical organisations working in the field of reproduction.  This means not only the IFFS, but also the World Health Organisation, ASRM, ESHRE, ICMART and others will all welcome this ruling”.
